HOUSTON — Two Harris County men are suing their employers, alleging failure to pay proper overtime.
Johnny Dickey III and Tierney Bostic filed a lawsuit July 25 in the Houston Division of the Southern District of Texas against
Infinity 1234 Inc. and Iman Nonahal,
alleging violation of the Fair Labor Standards Act.
According to the complaint, Dickey, a driver from August 2014 to the present, and Bostic, a driver for the defendant since December 2014, frequently worked approximately 70 or more hours per week without receiving overtime pay for all hours worked in excess of 40.
The plaintiffs allege the defendants failed to compensate them at a rate of one and one-half times their regular hourly rate for each hour worked more than 40 as required by the FLSA.
Dickey and Bostic seeks a trial by jury, unpaid back wages, liquidated damages, pre- and post-judgment interest, attorney fees, legal costs and such further relief the court deems equitable. They are represented by attorneys Thomas H. Padgett Jr. of Ross Law Group in Bellaire, and by Charles L. Scalise and Daniel B. Ross of the same firm in Austin.
