Galveston County couple alleges roof contractor owes $100,000

GALVESTON — A Galveston couple is suing a roof contractor, alleging breach of contract and breach of implied warranty.

Jim Earthman and Cindy Earthman filed a lawsuit July 27 in Galveston County District Court against Walton Residential Services LLC, alleging violation of the Residential Construction Liability Act.

According to the complaint, the Earthmans have been damaged because their roof at 6808 Driftwood, Galveston, continues to deteriorate because of the defendant's faulty construction and because they had to expend monies for correcting the defective roof. The plaintiffs allege the defendant improperly installed the roof, failed to honor warranty on its workmanship, and engaged in false and misleading practices.

The Earthmans seek a trial by jury, monetary relief up to $100,000, penalties, legal costs and expenses, attorney fees, pre-judgment interest and such relief to which they are entitled. They are represented by attorneys James B. Galbraith and Lyle Y. Courtney of McLeod, Alexander, Powel & Apfel PC in Galveston.
