Hair stylist accuses former employer of failing to pay overtime

HOUSTON — A Harris County hair stylist is suing her former employer, alleging violation of overtime laws.

Brenda Leal filed a lawsuit July 27 in the Houston Division of the Southern District of Texas against Mercer Salon LLC and Vielka Rivers, alleging they violated the Fair Labor Standards Act.

According to the complaint, Leal worked more than 40 hours per week between August 2015 and July 2016 without receiving proper overtime compensation. The plaintiff alleges the defendants required her to work 9:45 a.m. to 7 p.m. Tuesday through Friday and 8:45 a.m. to 4 p.m. Saturdays without lunch breaks, failed to pay her the minimum wage of at least $7.25 per hour, failed to pay her overtime premium of time and a half as required by the FLSA.

Leal seeks a trial by jury, unpaid back wages, an equal amount of liquidated damages, pre-judgment interest, attorney fees and all equitable relief. She is represented by attorneys Thomas H. Padgett, Jr. of Ross Law Group in Bellaire and Charles L. Scalise and Daniel B. Ross of the same law firm in Austin.
