Customer blames clothing store's negligence for injuries

BEAUMONT — A Jefferson County woman is suing a Port Arthur store, alleging its negligence caused her to fall and suffer injuries.

Maiyelin Quintana filed a lawsuit July 20 in Jefferson County District Court against Ross Dress For Less Inc. alleging negligence in failing to prevent injuries to the plaintiff. 

According to the complaint, on March 16, Quintana was entering the Ross Dress for Less store at 8825 Memorial Blvd., Port Arthur, when she tripped and fell on an unknown object, causing her to sustain injuries to her knee. The suit says the fall caused pain and mental anguish, physical impairment and disfigurement, loss of earning and medical expenses. 

The plaintiff alleges the defendant failed to maintain the premises in a reasonably safe condition, failed to correct the dangerous condition and failed to warn Quintana of said dangerous condition.

Quintana seeks a trial by jury, monetary relief of up to $75,000, including damages and penalties, legal costs and expenses, pre and post-judgment interest and all other relief to which she is entitled. She is represented by attorneys John Arthur Daspit and Eduardo Javier Garza of Daspit Law Firm in Houston.
