Customer alleges restaurant's negligence led to injuries

GALVESTON — A Galveston County woman is suing a Kemah restaurant, alleging its negligence caused her to sustain injuries.

Donna Wilkerson filed a lawsuit July 28 in Galveston County District Court against Cass No. 2 Cajun Restaurant, doing business as Crazy Alan's Swamp Shack, alleging negligence in failing to exercise the degree of care to avoid harm to others.

According to the complaint, on Feb. 18, 2014, Wilkerson was at Crazy Alan’s Swamp Shack and, while eating, she lost her footing on the top step of the stairs due to the fact the steps were at uneven levels.

The subsequent fall, the suit says, caused Wilkerson to sustain severe injuries to her head, neck and back and great shock to her entire nervous system. The lawsuit states she sustained great physical and mental pain, suffering, anguish, lost wages and medical care and expenses. 

The plaintiff alleges the defendant failed to inspect the premises to make sure no dangerous conditions existed and failed to maintain a safe premises,.

Wilkerson seeks trial by jury, monetary relief of more than $ 1 million, pre- and post-judgment interest, costs of court, and such other relief to which she is entitled. She is represented by attorney Christopher Kwon of Kwon Law PLLC in Pearland.
