Worker alleges former employers failed to pay overtime

HOUSTON — A Texas man is suing his former employers, alleging failure to pay proper overtime wages.

Gonzalo Burgos filed a class action complaint, individually and on behalf of all similarly situated persons, July 28 in the Houston Division of the Southern District of Texas against Arevalo Manufacturing Inc. and Jesus Arevalo, alleging failure to comply with the overtime provisions of the Fair Labor Standards Act.

According to the complaint, between January 2007 and July 7, 2016, Burgos regularly worked 60 hours or more per week as a painter and a welder without receiving any overtime premium for any hours worked more than 40 per week. The plaintiff alleges the defendants willfully disregarded his federally protected rights, failed to pay the required overtime premium and continued to pay their employees straight time only even after the conclusion of their first FLSA lawsuit.

Burgos seeks a trial by jury, all unpaid overtime wages, liquidated damages, pre-judgment interest, attorney fees, legal costs and all relief the court deems just and equitable. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Buenker Law in Houston.
