HOUSTON — A Harris County man is suing a food delivery service company, alleging failure to pay overtime.
Dewey Edwards filed a class action lawsuit, individually and on behalf of all others similarly situated, July 28 in the Houston Division of the Southern District of Texas against Doordash Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, Edwards did not receive minimum wage and overtime premium for each hour worked in excess of 40 per week. The plaintiff alleges Doordash Inc. misclassified him as an independent contractor, failed to pay the statutory minimum wage rate and and refused to pay overtime compensation at a rate of one-and-one-half times his regular rate of pay for each hour worked of more than 40 per week, according to FLSA regulations.
Edwards seeks trial by jury, an order allowing this case to proceed as a collective action, all unpaid overtime wages, lost wages, liquidated damages, attorney fees and court costs, pre-judgment and post-judgment interest and all relief to which he is justly entitled.
