Train operator blames tractor-trailer business for wreck

HOUSTON – A train operator for Kansas City Southern is suing a tractor-trailer business, alleging the defendant's negligence caused a crash that injured the plaintiff.

Maureece Oliver of Yuba City, California, filed a lawsuit against H&A Trans Inc., Singh Gurpreet, and the Diamond Transportation Company Sept. 6 in Harris County District Court  alleging negligence following a collision between a tractor-trailer and a train the plaintiff was operating.

According to the complaint, on Oct. 9, 2014, Oliver was working as a train operator for Kansas City Southern when his train collided with a tractor-trailer owned and operated by H&A and Diamond and driven by Gurpreet. The suit says the tractor-trailer was blocking the tracks, and the plaintiff sustained permanent injuries from the wreck.

The lawsuit accuses the defendants of gross negligence and violating laws and state statues regarding traffic, railroad crossings and tractor trailers. The plaintiff alleges the defendants’ negligence caused him physical impairment, disfigurement, mental anguish, lost earnings and benefits, and medical expenses. 

Oliver seeks monetary relief of up to $75,000, pre-judgment and post-judgment interest, costs of suit, exemplary damages from all defendants, and all other relief the court deems proper. He is represented by attorney Bristol Baxley of Rome, Arata & Baxley of Pearland.
