Man claims assault at apartment complex, files lawsuit against landlord

GALVESTON – An alleged assault at a Bacliff apartment complex earlier this year resulted in a lawsuit.

In recent court documents filed Aug. 30 in the Galveston County 10th District Court, Britton Van Wagner claims that David William Lee Boyd “violently and aggressively” attacked him at the property located at 4106 Coon St. last May 11.

Van Wagner asserts that Boyd, who is not a party in the litigation, “stabbed him in the lower torso and left him for dead,” stating the subject event was unprovoked.

The plaintiff further shows that he could not work nor drive after his initial hospital stay.

The suit implicates the apartments’ landlord, Jose Cavero, for employing Boyd despite the latter’s apparent propensity to violence.

Consequently, Van Wagner seeks unspecified monetary damages and a jury trial.

He is represented by attorney Cris A. Rasco of the Rasco Law Firm in Texas City.
