GALVESTON — Two Galveston licensed vocational nurses are suing nursing home facility operators, alleging failure to pay proper overtime.
Tennile Gray and Edna Robinson filed a lawsuit Aug. 19 in the Galveston Division of the Southern District of Texas against Villa Del Mar at Mainland Center LLC, Advantage Home Care Inc., OnPointe Management LLC and Jeremy Martin, alleging violation of the Fair Labor Standards Act.
According to the complaint, Gray and Robinson routinely worked more than 40 hours per week without receiving overtime premiums for any hours worked in excess of 40 per week.
The plaintiffs allege the defendants failed to pay overtime and failed to maintain accurate employee time and pay records.
Gray and Robinson seek trial by jury, all unpaid overtime wages, liquidated damages, reasonable attorney fees, court costs and expenses, pre and post-judgment interest, plus all other and further relief. They are represented by attorney Douglas B. Welmaker of Dunham & Jones PC in Austin.
