GALVESTON — A Hidago County man is suing a League City business, alleging the defendant's negligence caused the plaintiff to be run over by a forklift.
Jose Ibarra filed a lawsuit Aug. 16 in Galveston County District Court against INEOS Polymers Inc. of League City, alleging the defendant breached its duty to protect employees.
According to the complaint, on May 1, while Ibarra was working at the defendant’s Chocolate Bayou plant in Alvin, he was seriously injured when another employee who was operating a forklift ran into the plaintiff's back. The suit says the incident resulted in serious injuries that caused Ibarra to suffer physical pain, mental anguish, medical expenses, lost wages and disfigurement.
The plaintiff alleges INEOS failed to provide a reasonably safe area to work, failed to enforce safe speed limits on its premises and failed to train its employees on the proper operation of forklifts.
Ibarra seeks trial by jury, monetary relief of more than $1 million, pre- and post-judgment interest, court costs and all other relief to which he is justly entitled. He is represented by attorneys Keith W. Lapeze and Taylor Shipman of Lapeze & Johns PLLC in Houston.
