Woman seeks benefits from Allstate after incident with underinsured motorist

BEAUMONT – A Jefferson County woman alleges her insurer failed to provide benefits after she was injured by an underinsured motorist.

Tamara Spikes filed a complaint in Jefferson County District Court against Allstate Fire and Casualty Insurance Co. alleging that the underwriting company failed to comply with the provisions of the insurance contract.

According to the complaint, the plaintiff alleges that on May 2, 2013, she sustained personal injuries in an automobile accident due to the negligence of an underinsured motorist. As a result, she claims she incurred expenses for medical care and treatment, but has not received her benefits under the insurance policy. The plaintiff holds Allstate Fire and Casualty Insurance Co. responsible because the defendant allegedly refused to settle and pay reasonable benefits.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of no more than $70,000 for pre- and post-judgment interest, court costs and for such other relief to which she may show herself justly entitled.
