Rosenberg motorist accuses Ford of design defect

GALVESTON — A Rosenberg motorist is suing Ford, alleging negligence and a manufacturing defect.

Philip Tracy filed a lawsuit Aug. 31 in the Galveston Division of the Southern District of Texas against Ford Motor Company alleging negligence in failing to provide a crashworthy vehicle.

According to the complaint, on April 30, 2016, Tracy was driving a 2005 Ford Focus westbound on state Highway 6 in Galveston County when he was struck by an eastbound vehicle attempting to cross his lane of travel. The suit says the crash caused Tracy serious injuries, pain and suffering, impairment, disfigurement and medical expenses even though he was properly seated and wearing a three-point safety belt. 

The plaintiff alleges Ford failed to provide proper safety, failed to use knee airbags and failed to use boron steel and ultra high-strength steel in making the Ford Focus.

Tracy seeks trial by jury, actual damages, pre- and post-judgment interest, costs of suit and all other relief the court deems proper. He is represented by attorneys E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
