HOUSTON — Three former employees are suing a Houston marine equipment manufacturer, alleging violation of workers compensation acts in failing to pay overtime.
Donald Carter, Glen Bailey, both of Harris County, and Jose Mario Perez, of Bend County, filed a class action lawsuit, individually and on behalf of all others similarly situated Aug. 31 in the Houston Division of the Southern District of Texas against Thrustmaster of Texas Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, Carter and Bailey, both employed as assembly technicians, and Perez, an assistant mechanic, regularly worked in excess of 40 hours each week without receiving overtime compensation. The plaintiffs allege Thrustmaster of Texas illegally doctored their time records by changing their actual arrival and departure times using an automated time recording system to avoid paying the overtime premium as required by FLSA.
The plaintiffs seek trial by jury, an order allowing this case to proceed as a collective action, compensation for unpaid overtime wages, lost wages, liquidated damages, attorney fees and court costs, pre- and post-judgment interest and all other relief.
