Two ex-employees allege oilfield services provider failed to pay overtime

Late 04

HOUSTON — Two former employees are suing an oilfield services provider, alleging violation of workers compensation acts in failing to pay overtime.

Frank Neal and Joseph Bonner filed a lawsuit Sept. 7 in the Houston Division of the Southern District of Texas against Temco Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, during the plaintiffs' employment with Temco starting in 2015, Neal and Joseph Bonner received compensation at a flat per day rate, regardless of hours worked. The plaintiffs allege Temco willfully refused to tender payment of overtime wages owed to Neal and Bonner for more than 40 hours of work per week.

Neal and Bonner seek trial by jury, judgment against the defendant plus court costs, reasonable attorney fees and all other remedies the court deems just and appropriate. They are represented by attorneys James M. Loren, George Z. Goldberg and Rachael Rustmann of Goldberg & Loren PA in Dallas.
