HOUSTON — A Harris County man is suing a Houston company, alleging violation of workers compensation acts by failing to pay overtime wages.
Jacob R. Salais filed a class action complaint, individually and on behalf of all others similarly situated, Sept. 7 in the Houston Division of the Southern District of Texas against Houston Distributing Company Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, during Salais' employment as a flow rack technician with Houston Distributing he worked more than 40 hours per week without receiving overtime compensation at a rate of time and one-half his regular rate for those hours worked in excess of 40.
The plaintiff alleges the defendant improperly deducted wages for lunch periods that were not taken.
Salais seeks trial by jury, an order designating a collective action, all unpaid wages, attorney fees, court costs and expenses, pre- and post-judgment interest and all other relief.
