ICI Construction Inc. alleged to have damaged MTO Center

HOUSTON – A California nonprofit corporation alleges a construction company damaged its Houston property.

Maktab Tarighat Oveyssi Shahmaghsoudi, doing business as M.T.O Shahmaghsoudi, filed a complaint on Sept. 12 in Harris County District Court against ICI Construction Inc. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that it sustained damages to its MTO Center in Houston, including but not limited to costs of construction, repairs, replacement and restoration of the HVAC system and other damages to its equipment and property. The plaintiff holds ICI Construction Inc. responsible because the defendant allegedly improperly manufactured and/or installed the construction components, defectively constructed the roofing system, HVAC system, window system, building envelop system and the civil grading and drainage.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages exceeding $1 million plus monetary relief of over $1 million, attorney's fees, costs and expenses, pre- and post-judgment interest and such other relief to which it is justly entitled.
