Seaman blames ship operator for injuries

HOUSTON — A seaman is suing deep water vessel operators, alleging their negligence led to the plaintiff suffering injuries. 

Robert Garcia filed a lawsuit Sept. 13 in Harris County District Court against Transocean Drilling USA Inc. and Transocean Offshore Deepwater Drilling Inc., alleging they violated their own safety rules and regulations.

According to the complaint, on June 1, 2015, Garcia was working as a senior tool pusher assigned on the at defendants' vessel, Discover Americas when he became seriously ill. The suit says his illness was the result of food ingested while aboard the vessel. As a result, Garcia sustained pain and suffering, mental anguish, medical expenses and the loss of earning capacity, the lawsuit states. 

Despite his suffering, the suit says, the Transocean failed to provide Garcia with timely or adequate medical care, which led to the plaintiff sustaining permanent damage to his internal organs.

The plaintiff alleges the defendants failed to properly train and supervise its crew, failed to inspect maintain and repair its equipment and failed to provide adequate medical treatment.

Garcia seeks trial by jury, monetary relief of more than $1 million, pre- and post-judgment interest, costs of court and all other relief. He is represented by attorneys Kurt B. Arnold, Micajah D. Boatright and Adam D. Lewis of Arnold & Itkin LLP in Houston.
