Transport business accuses insurers of violations

MARSHALL — A North Carolina transport service provider is suing casualty insurance providers, alleging breach of contract.

Medallion Transport & Logistics LLC of Mooresville, North Carolina, filed a lawsuit Sept. 16 in the Marshall Division of the Eastern District of Texas against American International Group Inc., Granite State Insurance Company and Jay Carman, alleging violation of the Texas Insurance Code.

According to the complaint, Medallion suffered financial damages when it was forced to contribute $200,000 of its own funds to complete a settlement on a vehicular accident in April 2011 and to avoid a future verdict in excess of the policy limits. 

The plaintiff alleges the defendants failed to provide protection from the excess verdict of $1.75 million to $3 million and failed to settle the matter within the policy limits.

Medallions Transport & Logistics seeks trial by jury, judgment for all damages, attorney fees, prejudgment interest, costs of court and all other relief. It is represented by attorneys Carl R. Roth, Amanda A. Abraham and Todd W. Smith of The Roth Law Firm PC in Marshall.
