HOUSTON — A field hand has filed a class-action lawsuit against Express Energy LLC, an oilfield operator, citing alleged violation of workers compensation acts.
John Crain filed a complaint on behalf of all others similarly situated persons on Sept. 16, in the Houston Division of the Southern District of Texas against Express Energy LLC alleging that the oilfield operator violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he regularly worked in excess of 40 hours per week without receiving extra half-time pay of his regular rate for all hours worked in excess of 40 in a workweek. The plaintiff holds Express Energy LLC responsible because the defendant allegedly failed to include non-discretionary bonus pay, into his regular rate when calculating and paying his overtime compensation and failed to pay overtime at the proper rate.
The plaintiff requests a trial by jury and seeks judgment against defendant for unpaid back wages due, liquidated damages, costs of this action, attorneys’ fees pre- and post-judgment interest and such other and further relief.
