HOUSTON — A Harris County couple is suing a Mississippi husband and wife, alleging they owe more than than $100,000 for breach of contract.
Francis Paul Stack III and Sheri Stack filed a complaint on Sept. 16, in the Harris County District Court against Clarence Moore and Jacqueline Moore of Greenville, Mississippi, alleging the defendants have refused to perform pursuant to the terms of their agreement.
According to the complaint, on April 15, 2012 and in conjunction with the purchase of a property in Houston, Francis Paul Stack III and Sheri Stack executed a wraparound real estate lien note and a wraparound deed of trust for the benefit of defendants. The suit says the home insurance policy is held in the name of defendants.
In 2015 and 2016, the lawsuit states, the Houston property sustained water damage. The Stacks contacted the Moores to file a claim for said damages.
The complaint says the defendants' inaction caused further damage to the property.
The plaintiffs allege the Moores refused to assist the Stacks in the execution of the modification agreement and failed to file a claim for the plaintiffs on the insurance policy.
The Stacks seeks trial by jury, recovery of more than $100,000, plus penalties, court costs, expenses, pre- and post-judgment interest, attorney fees and all other relief. They are represented by attorney Claude H. Davis III of Davis & Newsome PC in Houston.
