Parents blame child care facility operators for daughter's injuries

BEAUMONT — A Nederland husband and wife are suing child care facility operators, alleging their negligence led to injuries to the plaintiffs' daughter. 

John Doe and Jane Doe, individually and as next friends of Mary Doe, a minor child, filed a lawsuit Sept. 15 in Jefferson County District Court against Kindra Battenfield, Rodney Battenfield and Karen Battenfield, alleging they breached their duty of care to abide by generally accepted safety standards.

According to the complaint, on Sept. 13, while at the defendants' facility in Nederland, Mary Doe sustained multiple bite wounds to her face, arms and legs when she was bitten by another child. The suit says this caused her to suffer pain and mental anguish, physical impairment, disfigurement and medical expenses. 

The lawsuit states the defendants originally told the parents that their child had been injured when a swing fell on her head and then said she had been injured in a fall before finally texting the mother that Mary Doe had been bitten by another child.

The plaintiffs allege Kindra Battefield negligently allowed another child in her home to repeatedly bite Mary Doe.

The plaintiffs request a trial by jury, damages, pre- and post-judgment interest and all other relief to which they are justly entitled. They are represented by attorney Clay Dugas of Clay Dugas & Associates in Beaumont.
