Assistant manager accuses Dollar General operator of discrimination

Wrongful term 08

SHERMAN — A Denton woman is suing Dollar General, alleging employment discrimination and wrongful termination.

Michelle M. Thick filed a lawsuit Oct. 20 in the Sherman Division of the Eastern District of Texas against Dolgencorp of Texas Inc., doing business as Dollar General, alleging violation of the Americans with Disabilities Amendments Act.

According to the complaint, on March 27, 2015, Thick, who worked as an assistant store manager, needed to eat something to prevent her from losing consciousness due to diabetes. The suit says Thick took a candy bar and a bag of chips, costing a total of $3 from the shelf of the Dollar General store in Denton and ate them. The lawsuit states Thick was terminated April 4, 2015, for violating company policy, which caused her to sustain emotional pain and suffering, inconvenience and other non-pecuniary losses.

The plaintiff alleges Dollar General discriminated against her in the terms, conditions and privileges of her employment and failed to make reasonable accommodations for her diabetes.

Thick seeks trial by jury, compensatory damages, reinstatement to her former position, attorney fees, court costs and pre-judgment interest, plus all other relief. She is represented by attorney John E. Wall Jr of Law Offices of John E. Wall Jr in Dallas.
