Elevate Recoveries accused of threatening man to collect alleged debt

HOUSTON – A Houston consumer claims a debt collector unlawfully threatened him in an attempt to collect an alleged debt.

Andre Whiting filed a complaint on Sept. 29 in the Houston Division of the Southern District of Texas against Elevate Recoveries LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Texas Debt Collection Act.

According to the complaint, the plaintiff alleges that as a result of defendant's unlawful collection practices, he has suffered and continues to suffer actual damages, humiliation, emotional distress and embarrassment. The plaintiff holds Elevate Recoveries LLC responsible because the defendant's collector allegedly threatened him with imprisonment and to go to his place of employment if the debt was not paid.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory damages of $1,000, costs of litigation, attorney's fees, punitive damages and such other and further relief. He is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
