Customer blames Dollar General for fall

GALVESTON — A Galveston County man is suing Dollar General, alleging negligence led the to the plaintiff suffering injuries. 

Kevin Spears filed a lawsuit Oct. 5 in Galveston County District Court against Dolgencorp of Texas Inc., doing business as Dollar General, alleging failure to maintain its premises in a reasonably safe condition.

According to the complaint, on May 20 Spears was exiting the Dollar Genera store in Baclifff when he suddenly tripped over a pallet at the entrance. The suit says Spears fell to the ground and sustained serious injuries to his shoulder, knee and right wrist, causing him physical pain, mental anguish and incurring significant medical expenses involving surgery to his knee and shoulder. 

The plaintiff alleges Dollar General failed to remedy the dangerous condition on its premises and failed to provide adequate warnings.

Spears seeks trial by jury, monetary relief between $200,000 and $1 million, all costs of court, pre- and post-judgment interest and all other relief. He is represented by attorneys Scott P. Armstrong and Mary C. Arguello of Abraham, Watkins, Nichols, Sorrels, Agosto & Friend in Houston.
