Managing member accuses fellow official of unjust benefits

HOUSTON — A Harris County man is suing a Houston company and a co-managing member, alleging the defendants owe at least $100,000 for breach of fiduciary duty.

Lyle Bento and ex rel. Southern Goods LLC filed a lawsuit Oct. 9 in Galveston County District Court against Southern Goods LLC and Charles Bishop, ex rel. Southern Goods LLC, alleging Bishop unjustly acquired benefits at the plaintiff's expense.

According to the complaint, Lyle Bento and ex rel. Southern Goods LLC suffered monetary injury for receiving substantially less profit and loss of investment because Bishop utilized company's funds for his own use and for the benefit of his other business ventures, brought in additional investors without the plaintiff's consent and diverted plaintiff's money to himself.

Bento seeks trial by jury, an order preventing Bishop from acting as manager of Southern Goods, all damages of at least $100,000, forfeiture and disgorgement of profits, pre- and post judgment interest, attorney fees, court costs and any other relief to which he is entitled. The plaintiff is represented by attorneys Travis L. Shaw and Stephanie Do of Patout & Shaw PLLC in Stafford.
