Henderson County resident claims E.W. Wylie Corp.'s employee is at fault in a car accident

MARSHALL — A motorist is suing E.W. Wylie Corp., a vehicle owner, citing alleged insufficient measures were taken to prevent injuries.

Donald Duncan filed a complaint on Oct. 11, in the Marshall Division of the Eastern District of Texas against E.W. Wylie Corp. alleging that the vehicle owner negligently entrusted its vehicle to its employee, Jackie Lynn Hammon.

According to the complaint, the plaintiff alleges that, in Nov. 30, 2015, he was lawfully operating a motor vehicle, traveling in his correct lane when suddenly defendant's employee, Jackie Lynn Hammond, who was driving a vehicle owned by defendant, attempted to pass a vehicle ahead of him and struck plaintiff's vehicle head on. Plaintiff suffered severe property damages and injuries to his body. The plaintiff holds E.W. Wylie Corp. responsible because defendant's employee allegedly breached his duty to exercise ordinary care in operating the vehicle, failed to keep a proper lookout and passed a vehicle without checking if it was safe to do so.

The plaintiff requests a trial by jury and seeks award for actual and punitive damages, pre- and post-judgment interest, attorney's fees, costs of court and such other and further relief. He is represented by Benton G. Ross and Douglas C. Monsour of The Monsour Law Firm in Longview.
