GALVESTON — Two drivers have filed a class-action lawsuit against F&F Interests, Inc., SKF Interest, Inc. and Gary Farine, employers, citing alleged violation of workers compensation acts.
Mauricio Espinal Canales and Jesus Alberto Joya filed a complaint on behalf of all others similarly situated on Oct. 12, in the Galveston Division of the Southern District of Texas against the defendants alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that Mauricio Espinal Canales and Jesus Alberto Joya regularly worked longer than 40 hours without being properly compensated for their work in excess of 40 hours. The plaintiffs holds F&F Interests, Inc., SKF Interest, Inc. and Gary Farine responsible because the defendants allegedly failed to properly compensate them for their work in excess of 40 hours, at a rate not less than one and one-half times their regular rate and failed to maintain accurate time and pay records.
The plaintiffs request a trial by jury and seek an order allowing this action to proceed as a class action, award for unpaid wages, pre- and post-judgment interest, and for such other and further relief. They are represented by Melissa Moore and Curt Hesse of Moore & Associates in Houston.
