Sales clerk alleges he was not paid overtime while working at GNC in League City

GALVESTON – A former sales clerk for a vitamins and supplements franchise alleges he was not paid overtime.

Sean Lewis filed a complaint on Oct. 14 in Galveston Division of the Southern District of Texas against Nima Nutrition Inc. alleging that the vitamins and supplements provider violated the Fair Labor Standards Act.

According to the complaint, the plaintiff worked at the defendant's GNC store in League City. The plaintiff alleges that he worked approximately 58 hours or more per week throughout his employment with defendant from Aug. 27, 2015, until May 5 without receiving overtime pay. The plaintiff holds Nima Nutrition Inc. responsible because the defendant allegedly refused to pay overtime hours at a rate of time-and-one-half his regular rate for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks compensation of recoverable unpaid back wages, liquidated damages, expenses, costs of court, and attorneys' fees, pre- and post-judgment interest and all other equitable relief.
