Walmart shopper alleges liquid left in aisle caused fall

Slip01

HOUSTON – A Harris County woman has filed a suit against a big box store after she allegedly was caused to fall because of a liquid left on the floor of an aisle.

Precious Folks filed a complaint on Oct. 14 in the Harris County District Court against Wal-Mart Stores Inc. alleging that the retail store owner failed to maintain its premises in a safe condition.

According to the complaint, the plaintiff alleges that on March 2, she was shopping at defendants' Walmart store in Spring when she slipped and fell on a liquid substance on the floor. As a result of her injuries from the fall, she alleges she has suffered and will continue to suffer physical and mental pain, lost wages and medical expenses. The plaintiff holds Wal-Mart Stores Inc. responsible because defendant's employees allegedly negligently allowed and permitted the existence of the dangerous condition and failed to warn her of such dangerous condition.

The plaintiff requests a trial by jury and seeks award for all damages in a sum to be determined at trial, expenses and costs for this action, pre- and post-judgment interest and all other relief to which she may be entitled. She is represented by David K. Mestemaker of Mestemaker & Straub in Houston.
