SHERMAN – A Dallas consumer alleges a Florida debt collector continues to call him in an attempt to collect a debt from an unknown individual.
David Girard filed a complaint on Oct. 14 in the Sherman District of the Eastern District of Texas against Enhanced Recovery Co. LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Texas Debt Collection Act.
According to the complaint, the plaintiff alleges that beginning in December 2015, he began receiving calls from defendant attempting to collect an alleged debt of a female stranger. The plaintiff holds Enhanced Recovery Co. LLC responsible because despite being informed that it had the wrong number and demanded that all calls to his telephone number cease, the defendant allegedly continued to call. As a result of defendant’s unlawful conduct, he alleges has suffered and continues to suffer from humiliation, anger, anxiety, emotional distress, fear, frustration and embarrassment.
The plaintiff requests a trial by jury and seeks judgment against defendant for statutory damages of $1,000 per each and every violation, punitive damages, litigation and attorney’s fees, and such other and further relief.
