Kemah boat dealer alleges construction business owes nearly $500,000

GALVESTON — A Kemah boat dealer is suing a construction business, alleging the defendant owes nearly $500,000 for breach of agreement.

The Nautic Group Inc. filed a lawsuit Oct. 24 in Galveston County District Court against Denver Commercial Builders Inc., doing business as Reconn Construction Services, alleging the construction service provider failed to meet its obligations under the agreement.

According to the complaint, Nautic Group entered into an agreement wherein Reconn would design a building with 8,400 square feet of commercial offices within a budget of $1 million and a total project design fee of $135,875. 

As a result of the defendant's mistake, the suit says, Nautic Group was required to pay to redesign the building, causing four months of unnecessary and costly delays. The plaintiff alleges the defendant designed a building that was more than double the proposed budget and exceeded its own budget for design services, that it demanded additional payments and also threatened to file a fraudulent lien.

The Nautic Group seeks trial by jury, actual damages of $203,746.28 and lost profits of $288,000, treble damages, attorney fees, costs of suit, pre- and post-judgment interest and all other relief to which it is entitled. He is represented by attorneys Daena G. Ramsey and Christopher K. Chapaneri of Vaughan & Ramsey in Arlington, Texas, and Houston.
