Mother accuses health care providers of negligence during delivery

HOUSTON — A Texas City mother and her newborn child are suing health care providers, alleging their negligence led to the child suffering injuries during delivery. 

Rocio Santiago, individually and as next friend of a minor, filed a lawsuit Oct. 27 in Harris County District Court against HCA Holdings Inc., Clear Lake Regional Medical Center Inc., Mainland Medical Center, Dr. Joy Carter, et al, alleging failure to provide necessary labor and delivery care to Santiago and her newborn.

According to the complaint, on April 20, 2015, the baby boy was born via STAT Caesarean section at Mainland Medical Center with serious injuries that will affect him for the rest of his life, including cerebral palsy . The suit says Santiago suffered medical expenses and loss of service. 

The plaintiffs allege Carter failed to recognized that Santiago was at increased risk for needing a Caesarean delivery and failed to timely diagnose a protraction disorder of labor and proceed with a Caesarean delivery.

Santiago and her son seek trial by jury, judgment in an amount within the jurisdictional limits of the court, pre-judgment interest, costs of court and all other relief to which they are justly entitled.
