Motorist blames truck owner, driver for crash

Car accident 36

MARSHALL — A motorist is suing an Oklahoma  truck owner and a Michigan driver, alleging their negligence led to a crash that injured the plaintiff.

Meaghan Oney May filed a lawsuit Nov. 1 in the Marshall Division of the Eastern District of Texas against Liberty Truck & Trailer Leasing & Sales LLC of Tulsa and Donald Dallas Piercy II of Clarkston, Michigan, alleging Liberty Truck negligently entrusted its truck to an unlicensed, incompetent and/or reckless driver.

According to the complaint, on Nov. 7, 2014, May was carefully operating a 2008 Mercury Milan northbound on U.S. Highway 59 in Harrison County when Piercy, who was driving a truck towing a trailer owned by Liberty, suddenly struck the rear of the plaintiff's vehicle.

The suit says the crash caused May to suffer severe injuries and to endure anxiety, pain, and illness, medical care and expenses and pain and suffering. The plaintiff alleges Piercy failed to keep a proper lookout, failed to timely apply his brakes and failed to control the vehicle.

May seeks trial by jury, actual damages, post-judgment interest, court costs, fees and expenses and all other just relief. She is represented by attorneys Brent Goudarzi and Marty Young of Goudarzi & Young LLP in Gilmer.
