Estate representative, beneficiary blame truck owner, driver for traffic death

HOUSTON — An estate representative and beneficiary are suing a truck owner and a driver, alleging their negligence led to a fatal traffic crash. 

Steven Beard, as representative of the estate of John Harold Bryant, and Judy Bryant, beneficiary, filed a lawsuit Nov. 3 in Harris County District Court against Overland Express Company and Mayolo Gallegos of Houston, alleging Overland failed to properly train and supervise Gallegos to provide safe operation of its tractor-trailer.

According to the complaint, on Oct. 28, 2015, John Harold Bryant was driving on the entrance ramp of Interstate Highway 45 northbound in Willis where Gallegos was operating a tractor-trailer owned by Overland. The suit says Gallegos attempted to merge onto the ramp and caused a violent collision that resulted in multiple injuries to Bryant that caused his tragic death. 

The lawsuit says Judy Bryant suffered loss of love, comfort and society. The plaintiffs allege Gallegos changed lanes and turned when it was unsafe, failed to yield right of way and failed to maintain proper lookout.

Beard and Judy Bryant seek trial by jury, monetary relief of more than $1 million, pre- and post-judgment interest and all other equitable relief. They are represented by attorneys Timothy R. Hightower and Ivan J. Capellan of Hightower | Capellan in Houston.
