Collin County couple alleges debt collectors violated laws

SHERMAN — A Collin County is suing debt collectors, alleging abusive, deceptive and unfair debt collection practices.

Kim and John Lind filed a class action complaint, individually and on behalf of all others similarly situated, Nov. 7 in the Sherman District of the Eastern District of Texas against Berkshire and Lewis Litigation, Fisher & Burns Financial LLC and Berks & Lewis Litigation Group LLC, alleging violation of Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, as a result of defendants' actions, the Linds have suffered actual and statutory damages. The plaintiffs allege the defendants failed to identify themselves as debt collectors, attempted to collect a debt using false, deceptive, or misleading representation and threatened to take action that could not be legally taken.

Kim and John Lind seek trial by jury, an order certifying this case as a class action, actual damages, statutory damages of $1,000 for willfully committing violations, plus penalties, attorney fees, court expenses and costs, and all other appropriate relief. They are represented by attorney Walt D. Roper of The Roper Law Firm PC in Dallas.
