Technician alleges services business failed to pay overtime

HOUSTON — A former employee is suing a Baytown lawn and garden services provider, alleging violation of workers compensation acts in not paying proper overtime.

Timothy A. Comeaux, individually and on behalf of all others similarly situated, filed a class action complaint Nov. 10 in the Houston Division of the Southern District of Texas against Baytown C & M Equipment Company Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, in February Comeaux was terminated from his employment as a technician salesman at Baytown C&M. During his tenure with defendant, the suit says, he was required to work more than 40 hours per week without receiving any compensation for all time worked beyond 40 hours per week. 

The plaintiff alleges the defendant deliberately failed to pay overtime or minimum wage for all hours worked in excess 40 in each week in violation of FLSA.

Comeaux seeks trial by jury,an order declaring this proceeding a collective action, back wages, liquidated damages, costs of this action, attorney fees, interest and all other necessary relief. He is represented by attorney Megan A. Daic of Daic Law in Houston.
