Welder alleges pallet manufacturer failed to pay overtime

HOUSTON — A Houston man is suing a pallet manufacturer, alleging violation of workers compensation acts by not paying proper overtime wages.

Charles Flournoy, individually and on behalf of others similarly situated, filed a class action complaint Nov. 14 in the Houston Division of the Southern District of Texas against GPS Global Pallets Services LLC,  alleging violation of the Fair Labor Standards Act.

According to the complaint, Flournoy, who began working for GPS Global Pallets in March, has routinely worked approximately 20 to 30 overtime hours per month but was not paid time and a half for hours worked more than 40 per week as required by FLSA. 

The plaintiff alleges Global Pallets Services LLC failed to pay statutory overtime compensation by wrongly characterizing a portion of Flournoy's  wages as holiday pay in a deliberate attempt to avoid paying full overtime wage and failed to keep accurate time records.

Flournoy seeks trial by jury, compensation for all unpaid overtime hours, liquidated damages, attorney fees and costs, post-judgment interest and all other equitable relief. He is represented by attorney Taft L. Foley, II of The Foley Law Firm in Houston.
