Consumer blames bench press manufacturer for injuries

HOUSTON — A consumer is suing a Harris County bench press manufacturer, alleging negligent manufacturing led to injuries for the plaintiff. 

Michael Brent Hand filed a lawsuit Nov. 16 in Harris County District Court against Cap Barbell Inc. alleging violation of the Texas Deceptive Trade Practices Act.

According to the complaint, on Dec. 5, 2014, Hand sustained severe injuries as he was bench pressing a 90-pound barbell. The suit says Hand suffered past and future physical pain, mental anguish, economic loss and damages and medical expenses. 

The plaintiff alleges Cap Barbell failed to design the Cap Barbell utility bench with sufficient weight capacity and negligently placed it into the market in an unreasonably unsafe condition.

Hand seeks trial by jury, judgment between $100,000 and $200,000, pre- and post-judgment interest, costs of court and all other equitable relief. He is represented by attorneys Tamara Brock Segal and Stephen Goetzmann of Brock & Goetzmann PLLC in Dallas.
