HOUSTON – Alleging an error in the refill of his topical medication caused him to suffer breakouts, Houston resident Eric Williams has filed a lawsuit.

Williams’s suit against CVS Pharmacy, Inc., filed Dec. 15 in the Harris County 333rd District Court, claims that the retailer at 2828 Spears Road in Houston last year gave Williams a dosage of Clindamycin Phos-Benzoyl with a strength greater than what his dermatologist had ordered.

Williams used the medicine to treat a mild case of folliculitis. Per recent court documents, the plaintiff did not realize CVS’s error as he applied the gel in accordance to his doctor’s instructions and what was printed on the label for several days.

The complainant further asserts that the medication left him with severe burns and lesions, insisting he did not in any way contribute to his ordeal.

A jury trial is requested.

Attorneys Ryan A. DeHoyos and Kevin J. Connolly of the law firm DeHoyos & Connolly, PLLC in Houston are representing Williams.
