2 employees allege call center companies failed to pay proper wages

MARSHALL — Two employees are suing call center companies, alleging violation of workers compensation acts in failing to pay proper wages.

Sarah Ellis and Annette Jackson, individually and on behalf all others similarly situated, filed a class action complaint Nov. 22 in the Marshall Division of the Eastern District of Texas against Universal Cable Holdings, Inc. and Altice USA, a subsidiary of Altice NV doing business as Suddenlink Communications, alleging violation of the Fair Labor Standards Act.

According to the complaint, Ellis and Jackson suffered monetary losses for not being paid overtime compensation from their sales commissions as telephone-dedicated contact agents and their pre-shift and post-shift duties. 

The plaintiffs allege the defendants failed to include the sales commission and pre-shift and post-shift duties in calculating overtime wages.

Ellis and Jackson seek trial by jury, judgment for all unpaid back wages due, costs of court, attorney fees, post-judgment interest and all other necessary relief.
