Six workers allege electrical contracting company failed to pay overtime

HOUSTON — Six workers from Harris County are suing an an electrical contracting company, alleging violation of workers compensation acts in failing to pay overtime.

Oel Camerota Frometa, Kennys Rodriguez Cutino, Yasmani Oscar Fernandez Suarez, Carlos Wong Facenda, Juan Herrera and Daniel Alejandro Arreola, individually and on behalf of all others similarly situated, filed a class action complaint Nov. 23 in the Houston Division of the Southern District of Texas against Progressive Interest Inc., alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs regularly worked more than 40 hours per week as manual laborers without receiving proper overtime compensation. The plaintiffs allege the defendant failed to compensate them for all hours worked in excess of 40 per week at the mandated rate of time and one half their regular rate of pay as required by FLSA.

The plaintiffs seek trial by jury, compensation for all unpaid overtime wages, liquidated damages, pre- and post judgment interest, attorney fees, court costs and expenses, and all other equitable relief. They are represented by attorney Joe Jones of Sloan Law Firm in Houston.
