Tenants blame landlord for injuries from collapsed ceiling

HOUSTON — Two tenants are suing a Houston landlord, alleging the defendant's negligence led to a collapsed ceiling that injured the plaintiffs. 

James Bennett and Jacqueline Harvey filed a lawsuit Nov. 28 in Harris County District Court against Stewart M. Joseph, alleging the defendant breached his duty to exercise ordinary care to ensure the premises was safe.

According to the complaint, on July 27, 2015, James Bennett and Jacqueline Harvey were severely injured while sleeping on Joseph's property at 13911 Buffalo Speedway, Houston, when the ceiling collapsed on them. As a result, the suit says they have suffered, pain and anguish, disfigurement and medical expenses. 

The plaintiffs allege Joseph failed to inspect and properly maintain the premises, failed to warn plaintiffs of the potential dangerous condition and failed to implement safety regulations.

Bennett and Harvey seek trial by jury, monetary relief of more than $500,000, pre-judgment interest, costs of court and all other proper relief. They are represented by attorney Jacqueline N. Reid of Thurlow & Associates in Houston.
