Customer blames retail store operator for injuries

SHERMAN — A Collin County man is suing a retail store operator, alleging the store's negligence led to injuries for the plaintiff. 

Robert Santiestevan filed a lawsuit Nov. 30 in the Sherman District of the Eastern District of Texas against Braum's Inc. alleging failure to exercise reasonable care to protect its customers.

According to the complaint, on Dec. 13, 2014, Santiestevan was a paying customer on Braum's property in Frisco, Texas, when he slipped and fell on a wet and slippery floor. The suit says he sustained serious and life-altering injuries and was caused to suffer pain and suffering, mental anguish, loss of earning capacity and medical expenses. 

The plaintiff alleges Braum's Inc. failed to provide a safe place to shop, failed to remedy the dangerous condition created by its employee and failed to warn plaintiff of the existence of said dangerous condition.

Santiestevan seeks trial by jury, damages within the jurisdictional limits of the court, interest, costs of court and all other relief. He is represented by attorney Daryoush Toofanian of Rad Law Firm in Dallas.
