Galveston Co. judge approves non-suit in apartment assault case

GALVESTON – A lawsuit over an assault at a Bacliff apartment complex was recently disposed, per current Galveston County District Court records.

Britton Van Wagner sued Jose Cavero in the Galveston County 10th District Court last August after one of Cavero’s workers attacked him at the property located at 4106 Coon St.

Van Wagner claimed that David William Lee Boyd stabbed him without provocation, blaming Cavero for employing Boyd despite Boyd’s apparent propensity to violence.

The plaintiff submitted a notice of non-suit with prejudice on Dec. 19. Per the notice, Van Wagner “no longer desires” to carry on with the litigation.

Galveston County 10th District Court Judge Kerry Neves issued an order granting the complainant’s notice the next day.

Court records show that Cavero did not offer a formal response to the lawsuit.
