HOUSTON — A Houston property owner is suing a neighboring auto repair business, alleging breach of an agreement regarding a fence.
Graywood LLC filed a lawsuit Dec. 7 in Harris County District Court against Byong Yu d/b/a Mikey's Muffler & Brakes Inc, doing business as Midtown Auto Service Inc., alleging the neighbor breached their fence and electrical service drop agreement and access agreement.
According to the complaint, on Oct. 18, 2016, Graywood entered into an agreement with Midtown Auto to allow plaintiff to remove a metal fence between their property on 4510 Almeda Road, Houston, and to access the defendant's property for the construction of Graywood's new building.
As a result of the defendant's actions, Graywood suffered monetary damages for the delay of the plaintiff project, losses on the job, lost time and profits. The plaintiff alleges the defendant refused to allow plaintiff access to Midtown Auto's property, called the police, alleging the plaintiff's crews were trespassing and threatened and scared the plaintiff.
Graywood seeks trial by jury, an order for Midtown Auto to allow the plaintiff to access the defendant's property, actual and economic damages, pre- and post-judgment interest, attorney fees and court costs, plus all other equitable relief.
