Elderly woman blames doctor for injuries

HOUSTON — A 74-year-old woman is suing a physician, alleging insufficient measures were taken to prevent injuries.

Virginia Harvey of Houston filed a complaint Dec. 7 in Harris County District Court against Dr. Ajay K. Aggarwal, alleging he breached his duty to perform as a reasonably prudent medical care provider.

According to the complaint, on Jan. 6, 2015, Aggarwal performed a lumbar radiofrequency ablation procedure on Harvey. As a result of the defendant's negligence, the suit says, Harvey suffered nerve injuries that made her unable to walk because of severe pain and weakness. 

The plaintiff alleges Aggarwal negligently placed the radiofrequency cannula in an incorrect position.

Harvey seeks trial by jury, monetary relief between $200,000 and $2 million, plus interest, costs of court and all other proper relief. She is represented by attorneys Steven R. Davis and John A. Davis Jr. of Davis & Davis, Attorneys at Law in Houston.
