Couple blames used car business for husband's injuries

GALVESTON — A Galveston County couple is suing a La Marque used car business, alleging insufficient measures were taken to prevent injuries to the husband.

Jesse Whittington and Sandy Whittington filed a lawsuit Dec. 12 in Galveston County District Court against Tony's Used Cars Inc., Tony Romany, Tony Venice and Tony Rami, alleging they breached their duty to provide a safe place to work.

According to the complaint, on Jan. 20, 2015, Jesse Whittington sustained serious and permanent injuries while working at the defendants' La Marque job site when a car fell on top of him. The suit says the incident caused him to suffer pain, mental anguish, loss of earning capacity and medical expenses. 

The plaintiffs allege the defendants failed to provide adequate training and supervision and failed to provide proper assistance and tools to perform Whittington's duties.

The Whittingtons seek trial by jury, monetary relief of more than $1 million, plus interest, costs of court and all other equitable relief. They are represented by attorneys Gary M. Freeman and Joshua Estes of The Estes Law Firm PC in Richmond.
