HOUSTON — A widow is suing Cigna insurance, alleging breach of an insurance contract.
Rosalina Bayutes Tinsley filed a lawsuit Jan. 19 in Harris County District Court against Life Insurance Company of America, doing business as Cigna Group Insurance, and Kellogg Brown & Root Inc., alleging failure to comply with the Texas Deceptive Trade Practices Act.
According to the complaint, Tinsely did not receive the accidental death benefits due from her husband's death by blunt force trauma Dec. 10, 2014. The suit says Michael Tinsley,was insured under Cigna's group accidental death policy issued to Kellogg.
The lawsuit states Bayutes Tinsley suffered the emotional hardship of having a second autopsy performed on her husband because Cigna ignored the original autopsy findings, denied her claim for accidental death benefits and said her husband's death was the result of natural causes.
Bayutes Tinsely seeks trial by jury, monetary relief of more than $1 million, attorney fees, costs of court, pre- and post judgment interest and all equitable relief. She is represented by attorneys Jan Woodward Fox and Cameron Weir of Houston.
