Liner service company alleges transport carrier caused cargo damage

HOUSTON — A New Jersey liner service company is suing a Houston inland transport service provider, alleging negligence caused damage to the plaintiff's cargo. 

Hamburg Süd North America Inc. of Morristown, New Jersey, filed a lawsuit Dec. 20 in the Houston Division of the Southern District of Texas against TXN Logistics alleging failure to perform services in a workmanlike manner.

According to the complaint, on Nov. 20, 2015, while TXN Logistics was transporting Hamburg Sud's container, it was involved in a single-vehicle accident that resulted in damages to the plaintiff's cargo of at least $25,974.91. The plaintiff alleges the defendant’s driver failed to pay attention to the road and failed to travel at a safe speed.

Hamburg Sud North American seeks trial by jury, declaration the defendant is liable for the plaintiff's damages, pre- and post-judgment interest, costs, attorney fees and all other equitable relief.
